Workplace Discrimination:
How free of prejudice are we - really?


Americans have a funny way of naming things.  We like to put things in boxes and call them something that sounds nice even when it isn't. The "right to work" often becomes the basis of "firing without justification."  Workplace intolerance for one person is thought of as protecting the staff for another.  How prepared are you to identify your principles and stick up for them?  Just because a policy seems reasonable and is actually not illegal does not necessarily make it a good policy.  Discrimination in the workplace can come in many forms and some of them are almost invisible.

Terminations are now news worthy

Thanks to BLR.com here are some questions you must answer before terminating an employee:

  1. Documentation. Do you have the records you need to show a legitimate business reason for the termination?

  2. Treatment in relation to others. Does it look as if you're out to "get" this employee?

  3. Discrimination. Is there a possibility that discrimination (sex, age, race, religion, workers' compensation, disability, national origin, marital status, garnishment, leave status, polygraph, etc.) could have been a factor in the decision to terminate?

  4. Unfair treatment. Will the employee soon vest in any bonus, retirement benefit, or other benefit?

  5. Retaliation. Has the employee recently filed a claim or made a complaint about safety, wages, harassment, etc.?
