"disabled worker" definition

Starting January 1, 2009 employers will need to rethink their understanding of what a disabled worker is and how they should be treated in the workplace. The ADAAA, an amended version of the ADA or Americans with Disabilities Act, states that employees who have been able to deal with their disabilities such as an artificial limb or medication are no longer covered under the original act. They must now be treated and evaluated as though he or she has not managed the impairment. According to the article a person is in violation of this law if "treated adversely-not hired, passed over for promotion, paid less etc." Make sure you review your employee handbooks and update it so its consistent with new laws, provide training to the appropriate personnel, and be careful of more lawsuits to be filed now that it is easier for applicants and employees to claim discrimination. |
